【回顾2009】公民社会十大新闻

编者按:中国公民社会正随着市场经济和民主政治的发展而迅速崛起,并对中国的经济、政治、社会生活产生日益重大的影响。促进公民社会成长,离不开大众公民意识、权利意识、责任意识的普遍觉醒,离不开社会对话沟通、权力与权利良性互动的机制建设。

年终岁尾,《半月谈》编辑部首次为读者从浩繁的社会新闻事件中,评选出2009年中国公民社会十大新闻。虽然一些事件在释放社会紧张、达成利益博弈的 同时表现为某种程度的社会冲突,但是,透过这些事件我们可以看到,参与社会治理的多元主体已经渐次涌现,政府与民间的良性互动正不断激活治理体系和制度向 善的力量,理性在公共治理中的分量正逐步上升。一个不断发展的公民社会,正在而且将更有力地对完善市场经济体制、转变政府职能、扩大公民参与、推进基层民 主、改善社会管理、促进公益事业等方面发挥越来越重要的作用。

一、温家宝做客新华网与网民在线交流,越来越多政府官员与网民亲密接触。

继胡锦涛总书记2008年在人民网与网民进行在线交流后,温家宝总理在2009年全国“两会”召开前夕,通过新华网同海内外网民进行了在线的文字与视频交流。

面对网民这一中国社会快速发展壮大的力量,各级官员纷纷上网问政,将之作为体察社情民意的重要手段。如广东省委书记汪洋给网友们的留言:“真诚欢迎大 侠们‘打好铁、抢沙发、盖高楼’,积极为广东经济社会发展建言献策,及时反映社会各界的呼声。”(注:网络用语,“打好铁”表示“发好帖”,“沙发”代表 第一个回帖,回复就像盖楼,回复越多楼越高,说明人气越旺。)湖南省委书记张春贤以实名发帖给网友拜年;江西省委书记苏荣网上问计,840多万网民倾情赴 约;贵州省委书记石宗源每天必到“地方领导留言板”看网友留言,遇到重要留言,还当场打印出来,力求尽快处理……

点评:网民这个群体中汇聚了社会不同阶层群体,官员上网成风尚,在进行重大决策前问政网民,可使各项决策更符合实际情况。不同成员之间能够实现有效沟通是公民社会的重要特征。高层领导和普通公众之间应该有更充分的沟通,更有效的互动。

二、公共预算观察志愿者以身“试”法推进公共财政透明。

从2006年起,公民李德涛等向15个中央部委、18个地方政府提出了查看预算案的申请。他们将自己称为“公共预算观察志愿者”。2009年5月27 日,李德涛看到了深圳市政府的2008年度部门预算草案;10月27日,卫生部向他们公布了一份接近完备的本级部门预算。在他们的努力推动下,2009年 10月,广州市财政局率先在网站上公布了广州市114个政府部门的预算,供浏览者免费下载。

点评:公民社会中公共财政的公开,是政府践行信息公开承诺、接受社会预算监督的重要表征。只有信息公开充分,才有参与的可能性和针对性,公民社会的进 程才能加快。而敢于依法主张公民不可剥夺的权利,不允许自己的法定权利被褫夺,这是中国公民社会成长的重要一步,甚至可以看做是标杆性事件。愿意投入到这 些工作中的公民越多,中国离公民社会就越近。

三、不强制所有销售电脑安装绿坝软件:公共政策在民意表达后发生转变。

2009年6月9日,工业和信息化部发布《关于计算机预装绿色上网过滤软件的通知》,要求7月1日之后在我国销售的所有个人电脑出厂时预装一款名为 “绿坝-花季护航”的上网过滤软件,进口计算机在我国销售前也将预装该软件,以避免互联网不良信息对青少年的影响和毒害。消息一出,引来众多网友的担忧与 讨论,议论集中于政府的善意保护能在多大程度上净化复杂的网络环境,以及如何防止这种信息屏蔽的权力被滥用。北京瑞风律师事务所律师李方平就安装绿坝软件 问题向工业和信息化部递交了信息公开申请与听证申请。最终,工信部表示不强制安装绿坝软件。

点评:在此项关涉互联网管理政策的发布、修正过程中,公众实现了富有成效的参与,其结果是促使一项公共政策实现了从富于强制色彩到尊重公民选择权的转变。这也表明,多元公共治理主体的参与,已经成为当今社会治理的重要特征。

四、“被××”成为社会热点。

2009年7月12日,网名“酱里合酱”的网友赵冬冬在论坛上发出《应届毕业生怒问:谁替我签的就业协议书?注水的就业率!》的帖子,称在他不知情的 情况下,学校已经与一公司签订了他的《就业协议书》,而自己连这个公司都没听说过。一时间,“被就业”迅速蹿红网络。而随着“被就业”一词的出现,很多 “怪现象”纷纷被冠上“被”字之名:被小康、被增长、被全勤……

点评:“被××”不是一个简单的文字游戏,它实际上向公权力发出了民意的警示:一方面要自省,公权力是有限权力,不能随意侵入个人合法的权利范畴;另一方面要自勉,必须加强公信力建设,让权力在阳光下运行,防止冒出更多“被××”的荒诞词汇来为这个“被时代”作注脚。

“被时代”的出现,也是公民权利意识觉醒的表现。“被××”受关注,必然带来对公权的约束。然而真正让权力收敛,让权利伸张,还需要法治理念的“被激活”。

五、“钓鱼执法”引发诘问,形成对政府依法行政的强大推动力。

2009年10月14日晚,上海市浦东新区发生一起涉嫌非法营运的执法事件,当事人孙中界在驾车行驶途中载运一名男子,被城市管理行政执法部门处罚、 扣车。后因孙中界对行政执法过程存有疑义而自断手指,引发社会各界关注。此前的2009年9月8日下午,张晖驾驶轿车因红灯停车,一名男子称腹痛希望搭载 一程。搭载“乘客”的张晖随后被闵行区交通行政执法大队执法处罚。两事件发生后,网络媒体与传统媒体共同发声、交互发力,社会舆论形成了对依法行政、施行 善政的有力监督和促进。最终,两区政府分别通过新闻发布会等形式,出面澄清事实,承认错误,并终结、撤销相应的行政处罚程序和决定,向社会各界公开致歉。 “钓鱼执法”相关责任人浦东新区副区长陆月星、浦东城市管理行政执法局局长吴福康受到了行政警告处分。

点评:孙中界的断指抗争,争得了人格尊严,争得了公民的权利。对“钓鱼执法”的诘问和反思,标志着公民权利意识的普遍觉醒。

六、长江大学学生救人,公民意识、责任的集中凸显。

2009年10月24日,在湖北荆州长江边秋游的一群长江大学一年级学生,发现2名在江中浅水区戏水少年被江流卷离浅滩后,几名同学从不同的方向跳入 波涛汹涌的江中救人,不会游泳的10多名男女学生手挽手涉水组成“人链”协助。两名落水少年得救了,而陈及时、方招、何东旭3名年仅19岁的大学生却献出 了宝贵的生命。28日,湖北荆州市数万民众送别3名英勇献身的大学生,荆州妇女流泪举起“儿子们,一路走好,不相识的母亲”的条幅。在这一群体感动中国 时,捞尸者挟尸要价的行为令人愤慨。

点评:大学生舍身救人,公民责任在具体行为中熠熠发光。如何让绝大多数个体的公民意识特别是公民责任在公民社会的发展中获得提升,是公民社会发展中必然要面对的课题。

七、广东召开首届网民论坛,为“南方民间智库”搭台。

2009年11月1日上午10点,上万名网友轻点鼠标,首届广东网民论坛在广东科学中心开坛。会场的座位构成了一个大大的“@”,来自全国的108名 网友绕圈而坐,拍砖灌水,纵论金融危机下广东的“生存法则”。同时,首批15名“南方民间智库”成员获得了烫金的聘书,这意味着“南方民间智库”这一开放 创新平等的平台正式搭建起来。

论坛源自网民,酝酿发起于民间,体现出网民“自治、自律、自组织”的精神。“废话一筐”、“肉唐僧”、“紫衣厨娘”……不设主席台的大圆桌协商,座位牌上也都是些稀奇古怪的网名。别具一格的会场布置,论坛的“草根性”和“多元化”一览无余。

点评:网民论坛,变过去网络问政的无序为有序的、有组织形态,尽管“民间智库”成员的特点是草根性、多元化,但可贵的是公民有了这个参与社会治理的稳定渠道。

八、七民间组织联合发布《2009中国公民社会应对气候变化立场》。

2009年11月17日,由自然之友、北京地球村、绿家园志愿者、公众环境研究中心、绿色和平、乐施会、行动援助等七家民间组织牵头组成的“中国公民 社会应对气候变化小组”在北京联合发布了《2009中国公民社会应对气候变化立场》(以下简称《立场》)。《立场》由七家核心机构牵头起草,后由近40家 机构参与讨论、修改,并最终联合署名,代表了中国民间机构对气候变化议题的认识和立场,同时也表达了对哥本哈根会议的期望。2007年巴厘岛会议期间,中 国民间组织也曾就气候变化发布《2007中国公民社会应对气候变化立场》。相比较而言,2009年《立场》在起草后公示期间,获得的公众反馈比2007年 热烈得多,许多NGO从不同的角度提出了意见和建议。

点评:NGO发育程度,是公民社会发展程度的重要标志之一。在环保领域,民间组织已成为中国环境事业发展中一支蓬勃生长的力量,然而2009年中国 NGO的成长仍然步履维艰。如何善待呵护民间热忱,释放民间对社会治理方面的智慧、创新、作为?期待2010年能够有更多亮点。

九、拆迁问题“五学者上书”,《城市房屋拆迁管理条例》被纳入修改工作日程。

2009年12月2日,CCTV“新闻1+1”节目播出的一段视频刺痛了全国观众的眼球:成都女子唐福珍站在自家4层小楼屋顶上,往身上浇汽油,然后 点火自焚。12月7日,北京大学法学院5位学者通过特快专递的形式向全国人大常委会递交了《关于对<城市房屋拆迁管理条例>进行审查的建议》,建议立法机 关对《城市房屋拆迁管理条例》进行审查,撤销这一条例或由全国人大专门委员会向国务院提出书面审查意见,建议国务院对《条例》进行修改。国务院法制办于 12月16日举行专家研讨会,就拆迁条例听取专家意见,并已经将《城市房屋拆迁管理条例》纳入修改工作日程。

点评:这一年连续发生的多起暴力拆迁和以极端方式对抗拆迁的事件,表明物权法这部“公民权利保障大法”在保障公民财产权方面还未充分发挥应有作用。其 背后的追问是,在本质上,城市的发展应建立在尊重个体公民权的基础之上,还是建立在以公共利益为名、开动公共机器损害个体公民权基础之上?对相关条例进行 修改,当是公民权获得更好保障的应有体现。在尊重和保护个体公民权益基础上实现更大范畴的公民权益,是必然要求和发展趋势。

十、公民以各种平和方式表达利益诉求。

广州市选址番禺区大石街会江村建生活垃圾焚烧发电厂消息传出后,周边10公里范围内的丽江花园、广州碧桂园、海龙湾等众多楼盘小区居民发起反对建设垃 圾焚烧发电厂的活动,12月10日,广州市番禺区表示,暂缓“垃圾发电厂”项目选址及建设工作,并启动有关垃圾处理设施选址的全民讨论。一位参与番禺垃圾 焚烧项目与群众对话的广州市政府官员说,过去我们习惯于在鼓励和表扬声中工作,而现在,我们必须学习在群众和舆论的批评和监督下推进工作,还要不断完善制 度,主动接受这些监督。

点评:社会治理离不开公民权益的充分表达,离不开治理主体与利益各方的充分互动和博弈。因共同利益诉求松散地联系在一起的非典型、非正式的社会组织, 对于集中表达群体利益诉求、规范个体公民诉求表达方式,能够发挥巨大作用。在我国进入社会矛盾凸显期后,公民权益的平和表达、有效维护,是中国公民社会不 断发展的一个重要成果。

TED Prize winner announced!

We're delighted to announce the TED Prize winner for 2010: the chef who's transforming the way we feed our children ...

JAMIE OLIVER

The prize grants him $100,000 -- and something much bigger: "a wish to change the world." He'll unveil the wish on February 10 at TED2010 and we, the TED community, will make it come true.

Some key achievements:

  • 12 television series, seen in 130 countries
  • 10 cookbooks, translated into 29 languages, and sold almost 24 million copies in 56 countries
  • His School Dinners/Feed Me Better campaign pressured the UK government to invest $1 billion to overhaul school lunches
  • Founded the Fifteen Foundation, a social enterprise and chef apprenticeship for 18-24 yr olds. Based in London, it has been replicated through franchising in Amsterdam, Cornwall and Melbourne
  • A new TV series, Jamie Oliver's Food Revolution USA, is to air on ABC in 2010, bringing Jamie's unique vision to America

At the heart of Oliver's work is an assault on the obesity epidemic: The CDC states that one in four Americans are considered obese. It is estimated that 43 percent of Americans, or 103 million people, will be obese by 2018. The cost of this epidemic is anticipated to reach $344 billion per year. It currently accounts for almost 10 percent of the yearly US health care costs, and that rate will rise to 21 percent by 2018. WHO's latest projections indicate that, globally in 2005, approximately 1.6 billion adults were overweight and projects that by 2015, that figure will rise to 2.3 billion.

From the New York Times:
"... this British celebrity chef has made it his mission in recent years to break people’s dependence on fast food, believing that if they can learn to cook just a handful of dishes, they’ll get hooked on eating healthfully. The joy of a home-cooked meal, rudimentary as it sounds, has been at the core of his career from the start, and as he has matured, it has turned into a platform."

Just one winner?

Those who've followed the TED Prize in recent years will know that in prior years we've announced three winners, not one. For 2010, the fifth-year anniversary of the launch of the prize, we're doing things differently.

When we first created the TED Prize, we envisioned supporting projects that could be completed in 12 months. But our winners have dreamed up wishes more powerful, more wonderful than we ever could have imagined, and we've found that we simply don't want to stop that quickly! Members of the community are getting passionately engaged in these projects, and they're not shy to tell us that changing the world can take more than a year ... To effect real impact, it's right to stay involved and sustain the effort.

We agree. And that means it would be a mistake to add three brand-new wishes every year. There are already 15 TED Prize projects, and at least half of them still require our engagement. Adding too many more risks dilution of effort.

Therefore, after discussion with various wise souls in the community, we are moving to a new format of ONE new winner every year. At the same time, we're increasing our capacity to facilitate your amazing efforts on the existing wishes:

There has been exciting progress on all these projects and we can see that there's much more to come.

It's incredibly exciting to welcome Jamie Oliver to join our line-up of change catalysts. And exciting, too, to know that our existing winners are going to stay at the heart of the TED community, as we continue working to realize their inspirational visions for a better future.

千村扶贫开发百村整体推进——866工程介绍

本网讯(记者 朱琳琳)根据中央的有关部署和要求,省委、省政府确定了:以基本解决绝对贫困人口温饱问题和巩固低收入人口的温饱为目标,紧紧瞄准贫困群体和贫困人口,以 贫困村为主战场,实施30户以上自然村整体推进。

    为了认真贯彻落实中央、国务院及省委、省政府对扶贫开发整村推进的要求,2005 年10月,大理州委、州人民政府按照全省“十一五”期间扶贫开发工作基本思路,制定了以行政村为基本单位,实行整村推进的大扶贫行动计划,并以866工程 为主要载体,整合社会各方资源,加大资金投入力度,提高扶贫资金使用效益,用十年的时间在全州范围内分年度分批实施1000个行政村的扶贫开发整体推进。 其中:“十一五”期间实施500个。每个村平均投入资金150万元左右,建立脱贫致富新机制,全面实施866工程,即:

    一、农户实 现八个有

    1、有青瓦白墙、院心硬化的抗震安居房;

    2、有沼气池(节能灶)或其他清洁能源;

    3、 有小水窖(池)或自来水;

    4、有卫生厕(公厕)、卫生畜厩或(独里畜厩);

    5、有稳定可靠的产业增收项目或 外出务工劳动力;

    6、人均有1头商品畜出售(大牲畜、羊、猪均可);

    7、人均有1亩400公斤以上的稳定农 田地;

    8、人均有1亩特色经济林果或经济作物。

    二、30户以上的自然村基本实现六个有:

    1、 有村组简易公路(或村容整洁、道路畅通);

    2、有安全卫生的饮用水;

    3、有入村入户的通电条件;

    4、 有2项以上形成规模的产业;

    5、有广播电视信号覆盖;

    6、有固定的村民议事地点或重大事项公告公示栏。

    三、 行政村总体实现六个有:

    1、有合格的村“两委”办公房和维护群众利益的好班子、好制度;

    2、有满足“普六” 要求的村完小;

    3、有满足初级卫生保健要求的村卫生室及医务人员;

    5、有科普文化室及相应的电教设备和书 刊;

    6、有通往村委会所在底的弹石公路或泥结石公路。

RCE Entrepreneur in Residence Honored at NPIM Weekend

Tom Stansbury holding his awardTom Stansbury, Center Entrepreneur in Residence, was honored earlier this past fall at Nehemiah Project International Ministries' annual conference.

Tom is passionate about kingdom business and the vision and mission of RCE: he taught the Biblical Entrepreneurship curriculum in Ukraine and has been a strong supporter of our Centers for Entrepreneurship here in the US and in Ternopil, Ukraine.

Ukraine Center Reaches Out to Children

The Success Center for Entrepreneurship in Ternopil Ukraine has begun teaching English to orphans and children from needy families. The children also learn Bible lessons their teachers gleaned from a seminar hosted by CBN Ukraine.

Business Development Centers: One Step Closer

Leaders at a meetingIn October, Center Director Dr. John Mulford and Strategist Jason Benedict traveled to Burundi to meet with government officials and leadership from the ICCC (International Christian Chamber of Commerce). Plans are well underway to open centers, starting in Rwanda and Burundi, as soon as funding becomes available. The curriculum is ready, some facilities are in place and we are excited to see what the Lord will do!

Missions and Business As Missions  

A current student in the Master's of Organizational Leadership program at Regent is a natural at business and missions. Working with a team in a strategic area of the world, a new business is thriving. But how does it work when someone who raises funds as a missionary has a successful business (as missions) venture?  Dr. John Mulford consulted with a top missions organization in Colorado last month to work on this very issue. Engaging the Head, Heart and Hands

John Mulford and Patrice Tsague presented the Biblical Entrepreneurship program at the annual CBFA conference, October 15-17. The conference draws together Christian business faculty from across the USA and around the world.

Special Guest Speaker:  Ford Taylor

Ford Taylor, speaking at Regent University on TransformationFord Taylor was the special guest of RCE for a PowerLunch on Transformational Leadership last month. Ford was instrumental in creating Transformation Cincinnati and Northern Kentucky, uniting believers in the region to make a difference in their community. His message, coupled with rare humility and transparency, is powerfully used by the Holy Spirit to touch hearts and change lives.

RCE Hosts Business Plan Competition Winner

Royalty TransportationJunior Anderson, co-founder and president of Royalty Transportation, was the winner of a business plan competition held at Destiny Metropolitan Worship Church last summer in Atlanta, in conjunction with Biblical Entrepreneurship training. Center Director Dr. John Mulford was one of the judges at the competition, and arranged for Junior to meet with local business professionals and share his vision for making a kingdom difference for his clients. Patrice Tsague, founder of NPIM and creator of the BE curriculum, also attended.

Staff Update:  We're Thankful!

Hanisha Besant, our new graduate assistant, is completing her BS in Psychology this semester and planning to continue her studies at Regent in the School of Communications.

Johncy Rajan, our former GA, is now back in the area after a stint in DC working with RCE partner Nehemiah Project International Ministries. Johncy is currently teaching business at a local college and helps the Center with projects as needed.

Thomas Noon, Entrepreneur in Residence, and Jason Graber are both much appreciated as they help the Center with projects that intersect with their expertise.

IRIS Advisory Meetings: Recap
Earlier this month, the GIIN held the first full meeting of the Impact Reporting and Investment Standards (IRIS) advisory committees. IRIS is a standardized vocabulary and framework for reporting the social and environmental performance of impact investments. The three IRIS advisory committees - Taxonomy, Strategy & Adoption, and Technology - each helped refine both the long-term goals for the initiative and the short-term tactical considerations. In 2010, an updated version of the taxonomy will be finalized and adoption will expand beyond the pilot organizations.

Impact Investor Spotlight: Triodos Investment Management

Each month, an impact investor discusses with the GIIN their motivations, their impact investment strategy, specifics about impact investing deals they’ve made, and challenges they face in this growing industry.
